Office for Harmonisation in the Internal Market, (Trade Marks and Designs) (OHIM),

defendant,

the other party to the proceedings before the Board of Appeal of OHIM, being

RS Components Ltd, established in Corby (United Kingdom),

Action brought against the decision of the Second Board of Appeal of OHIM of 16 October 2007 (Case R 531/2007-2), concerning opposition proceedings brought by the proprietor of trade mark RS against the application for registration of a figurative trade mark containing the letters RS.

1        By letter lodged at the Registry of the Court of First Instance on 11 April 2008, the applicant informed the Court, in accordance with Article 99 of the Rules of Procedure of the Court of First Instance, that it wished to discontinue proceedings.

2        As the present order is adopted before notification of the application to the defendant and the other party before the Board of Appeal, and thus before those parties can have incurred material costs, it suffices to decide that the applicant shall bear its own costs, in accordance with Article 87(1) of the Rules of Procedure.

3        The case will therefore be removed from the register.

On those grounds,

THE PRESIDENT OF THE SEVENTH CHAMBER OF THE COURT OF FIRST INSTANCE

hereby orders:

1.      Case T-501/07 is removed from the register of the Court of First Instance.

2.      The applicant shall bear its own costs.
